Terms of Use

1. Acceptance

By using Hapka ("the app") you agree to these Terms. If you don't agree, please don't use the app.

2. What Hapka is - and is not

Hapka is a tool for logging food and tracking calories and protein. It provides general nutrition information only. It is not medical, dietary, or health advice, not a medical device, and not a substitute for a qualified professional. Always consult a professional for medical or dietary decisions.

Any example meal plans, diet templates, or eating styles offered in the app (for example higher-protein, Mediterranean, ketogenic, or other named, therapeutic, or medical diets) are illustrative examples for general information only - not personalised, dietary, or medical advice. Whether a particular diet is appropriate for you, and how to follow it safely, must be discussed with your doctor or a qualified professional. Therapeutic or medical diets in particular should only be followed under medical supervision.

The optional "Personal plan" feature arranges foods you already log or pick yourself into an informational menu sized to targets you set or accepted. It works only with your own foods, is not a prescribed diet, a treatment, or medical or dietary advice, and Hapka does not guarantee any health or weight outcome. Review a generated menu with your doctor or a qualified professional before following it, especially if you have any health condition. The feature is unavailable where recommendations are off (see section 3).

3. Eligibility

Hapka is for adults aged 18 or over. It is not intended for minors, and it does not provide calorie or protein recommendations to people who indicate pregnancy/breastfeeding, a history of disordered eating, or a medically supervised diet - those users may log manually but should work with a professional.

4. Estimates and accuracy

Calorie and nutrition figures are estimates drawn from public food databases, AI interpretation of your text, and your own inputs; recommended daily targets use standard formulas (Mifflin-St Jeor). They can be inaccurate or incomplete. Hapka shows when a value is measured, estimated, or needs more detail, but does not guarantee accuracy. Use your judgement; do not rely on Hapka for medical purposes.

5. Your content and data

You keep ownership of what you log. You grant Hapka the limited permission needed to store and process it to provide the app's features, as described in the Privacy Policy. You can export or delete your data at any time.

6. Acceptable use

Use Hapka lawfully and for your personal use. Don't attempt to break, overload, reverse-engineer, or misuse the service or others' data.

7. Founding membership and payments

Hapka is free to use. You may optionally become a founding member for EUR 39/year. Payments are processed by Stripe; we don't store your card details. Your founding membership gives one year of access and does not renew automatically. Under EU consumer rules you have a 14-day right to withdraw; if you ask us to start paid access immediately, the right may not apply to the part already provided. To cancel or request a refund, email admin@hapka.app. Prices may change with notice; changes don't affect a period already paid.

8. Third-party services

Hapka relies on third-party services (e.g. food databases, AI processing, hosting, payments). Those are provided "as is" and we're not responsible for their content or availability.

9. Disclaimers

To the fullest extent permitted by law, Hapka is provided "as is" and "as available", without warranties of any kind. We don't warrant that estimates are accurate or that the service will be uninterrupted or error-free.

10. Limitation of liability

To the fullest extent permitted by applicable law, Borix Soft EOOD is not liable for any indirect, incidental, or consequential damages, or for health outcomes arising from reliance on the app's information. Nothing here limits liability that cannot be limited by law (including your statutory consumer rights).

11. Termination

You may stop using Hapka and delete your data at any time. We may suspend or end access if these Terms are breached or to comply with law.

12. Governing law

These Terms are governed by the laws of Bulgaria, without affecting mandatory consumer protections in your country of residence.

13. Changes

We may update these Terms; we'll post the new effective date and, for material changes, notify you in the app.
